The US federal appeals court on Friday rejected former President Trump’s request for a retrial of the $5 million civil verdict in the E. Jean Carroll sexual abuse case by an 8-2 vote. This ruling upheld the jury’s previous determination that Trump sexually abused columnist Carroll in the mid-1990s and that his remarks in 2022 constituted defamation. Carroll’s lawyer said that this decision once again confirmed that Trump was responsible for sexual assault and defamation.
A three-judge panel of the appellate court upheld the original verdict in December last year, dismissing Trump’s accusation of unfair trial. Although the two judges appointed by Trump raised objections, arguing that the trial was based on “unreliable evidence”, the majority of the judges believed that the case did not meet the criteria for a full court review. It is worth noting that Carroll received $83.3 million in damages in another related defamation lawsuit in 2023.
This case originated from Carroll’s accusation that Trump sexually assaulted her in the locker room of a department store in Manhattan in 1996. Trump has always denied all the accusations and was absent from the first trial. The appellate court will hold a hearing on the relevant appeal on June 24th.
